COLLECTION
& DEMAND LETTERS
We
send a collection letter, on the firm's letterhead to the person or company that
owes you money. Sometimes this gets the job done without further hassle or
expense. But even if your debtor doesn't make good on his debt, demand
letters establish a valuable paper trail in the event we need to take more
aggressive action.
SKIP
TRACING
An investigation into a debtor
with the purpose of identifying the debtor's true legal name, last known
address, and bankruptcy status. This information is critical when
attempting to collect from an unwilling debtor.
CREDIT
REPORTING
The person or business that owes you money
is reported to the major credit bureaus
Trans-Union™ and Experian™ as an
unpaid collection account. This information stays on their credit report
for up to 7 years. This service includes one demand letter instructing the
debtor to make immediate payment and that failure to act within the 30 days
required by law will result in the reporting of their bad debt to the credit
bureaus. If the debtor wrote a bad check, he or she will be reported to
the Shared Check Authorization Network (SCAN) and will likely have trouble
passing future checks to retailers who are part of the network.
ADD
COSTS, FEES & INTEREST TO JUDGMENT
When
you win a court case, the money the court awards you is called the "judgment."
But
you may have to pay fees to the Sheriff, the Court Clerk and others to collect
your money. The money you spend to collect your judgment is your
collection costs and fees. The law allows you to add these costs and fees,
along with interest to your judgment.
JUDGMENT
RENEWAL
Judgments
are enforceable for 10 years and are renewable for another 10 years.
Judgments can be renewed multiple times. Once a judgment has been renewed, it
cannot be renewed again until 5 years later. When the judgment is renewed, the
interest that has accrued will be added to the principal amount owed. From that
point on you are entitled to interest on the accrued interest. That's why
renewing a judgment is such a powerful tool!

EXAM
A
judgment debtor's exam is a process that allows a judgment creditor (anyone who
wins a "judgment") to compel the debtor to answer questions, under
oath, about his or her assets, property, and employment. This
is a powerful tool that can be used to uncover and help you go after the
debtor's personal property, bank accounts, and wages to collect your judgment.
PLACE
OR RELEASE LIEN
If
you are a judgment creditor, you may place a lien on any real property held by
your debtor. But once the judgment is paid, the lien must be released or
you could be liable to the debtor.
SEIZE
PROPERTY
A
judgment creditor may ask the court for an order to seize property held by the
debtor (and in some cases, the debtor's spouse) to satisfy a judgment owed by
the debtor.
